演讲题目 ： The Role of Competition in the Market for Adjudication
摘要(abstract)：
When a dispute arises between two or more parties, they often turn to adjudication to resolve it. The nature of the judicial doctrine that adjudicators apply—the set of rules by which they translate the facts of a case into a decision—is influenced by the institutions that characterize the market for adjudicators. Here I describe three institutional configurations, and examine the impact they have on judicial doctrine. I show that although elements of competition are present in all configurations, significant doctrinal pro-plaintiff bias is not.
